Trump’s DOJ Takes Aim at Corporate DEI Initiatives

The Department of Justice under a second Trump administration is poised to launch significant challenges against corporate Diversity, Equity, and Inclusion (DEI) initiatives. These programs, which have taken root across various sectors with the aim of diversifying corporate workforces, are now under scrutiny for potentially disadvantaging white and Asian job seekers. Legal experts are highlighting the DOJ’s arsenal of tools to combat what they perceive as racial bias in hiring practices, including investigations, lawsuits, and regulatory agreements.

The Trump administration’s approach to DEI is not new. In 2020, then-President Donald Trump signed an executive order targeting “race and sex stereotyping and scapegoating,” which was seen as a direct challenge to diversity initiatives. This order was rescinded by President Joe Biden in January 2021, who instead promoted “racial equity and support for underserved communities.” However, with the possibility of Trump’s return to office, the pendulum may swing back, potentially reshaping the landscape of workplace diversity efforts.

Legal Challenges and Corporate Response

Companies implementing DEI policies are already facing legal challenges from conservative groups. Walmart, for instance, has rolled back some of its diversity initiatives in response to such pressures. The legal battleground is expanding, with Project 2025 labeling DEI advocates as “woke culture warriors” and planning to use federal power against them. This aggressive stance has led to a chilling effect, with some institutions preemptively altering their language around diversity to avoid potential legal issues.

“The DOJ has a panoply of remedies it can seek to address the discrimination that results from these DEI programs,” David Pivtorak, an attorney who has brought cases against American Express over racial discrimination, said.
