(JustPatriots.com)- The Justice Department declined to have FBI agents oversee Joe Biden’s personal attorneys’ search for secret documents.
Although Joe Biden’s attorneys lack security clearances, they could search boxes of papers to find top-secret data. The transfer of the records to the DOJ was then made possible with the assistance of Biden’s White House Counsel.
The Justice Department and Biden’s attorneys agreed on how the searches would be carried out rather than sending armed FBI operatives to raid Biden’s Delaware properties.
The Justice Department would be notified immediately if any additional possibly classified papers were found, and Mr. Biden’s counsel would arrange for law enforcement officials to collect any such records. This was the agreement between the two parties.
According to people familiar with the situation, the Justice Department briefly considered having FBI agents oversee a search by President Biden’s attorneys for classified documents at his homes but ultimately decided against it to avoid complicating later stages of the investigation and because Mr. Biden’s attorneys had quickly turned over a first batch and were cooperating.
On Nov. 2, after Mr. Biden’s attorneys found classified documents from his time as vice president in an office he used at a Washington-based think tank, the Justice Department launched an investigation into how and why they ended up there. The legal team representing Mr. Biden planned to examine his other residences for any records that might be similar, and they talked with the Justice Department about the possibility of having FBI agents present as they carried out the extra searches.
Federal investigators appear to be preparing for a months-long investigation that might last far into Mr. Biden’s third year in office, according to the discussions and the Justice Department’s readiness to allow the Biden lawyers to conduct the searches without supervision.
According to current and former law-enforcement officials, the Justice Department would retain the authority to take a more muscular approach, including carrying out a future search warrant, if negotiations ever went confrontational. This is one reason not to involve the FBI at an early stage.
